GENERAL TERMS & CONDITIONS 

 

Welcome to the hadrianswall.ltd.uk website terms and conditions for use. These terms and conditions apply to the use of this Website and by accessing this Website and/or placing an order you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions you may not use or access this Website.

Before you place an order, if you have any questions relating to these terms and conditions please contact us by e-mail, or call us on 01434 344 650 between 9am-6pm (UK time zone).

1. DEFINITIONS

"Conditions" means these terms and conditions and the Special Conditions; "Product" means a product displayed for sale on the Website; "Product Description" means that part of the Website where certain terms and conditions in respect of the individual Product are provided; "Special Conditions" means the terms and conditions in the Product Description; "Users" means the users of the Website collectively; "Personal Information" means the details provided by you on registration; "We/us" means Hadrian’s Wall Ltd; "Website" means the website located at www.hadrianswall.ltd.uk or any subsequent URL which may replace it; "United Kingdom" means England, Wales, Scotland, Northern Ireland and the Channel Islands and "You" means a user of this Website.

You are provided with access to this Website in accordance with these Conditions and any orders placed by you must be placed strictly in accordance with these Conditions.

Registration

You warrant that: The Personal Information which you are required to provide when you register as a customer is true, accurate, current and complete in all respects; and you will notify us immediately of any changes to the Personal Information by contacting us by e-mail, or calling us on on 01434 344 650 between 9am-6pm (UK time zone).

You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

Indemnity

You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person accessing the Website using your shopping account and/or your Personal Information.

We reserve the right to:

modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. 3. PRODUCT PURCHASE

Orders

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

Contract creation and electronic contracting

The technical steps required to create the contract between you and us are as follows:

You place the order for your products on the Website by pressing the confirm order button at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the Website.

We will send to you an order acknowledgement email detailing the products you have ordered. This is not an order confirmation or order acceptance.

As your product is shipped from our store we will send you a despatch confirmation email.

Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the Products ordered unless we have notified you that we do not accept your order, or you have cancelled it in accordance with the instructions.

Non-acceptance of an order may be a result of one of the following:

a. The product you ordered being unavailable from stock.

b. Our inability to obtain authorisation for your payment.

c. The identification of a pricing or product description error.

d. You not meeting the eligibility to order criteria set out in the main Terms & Conditions.

The contract will be concluded in English.

Contract cancellation

Please note that you are entitled to cancel this contract if you so wish provided that you exercise your right no longer than eight working days after the day on which you receive the Products.

If you wish to exercise your right to cancel this contract after your order has already been despatched please follow the procedure set out in our Returns procedure.

Please note that your right to return Products does NOT apply to Products which fall into the following categories unless they are faulty:

a. Goods made to your specification

b. Perishable goods (for example foodstuffs)

c. Cosmetics

d. CDs, DVDs, or videos.

We will take all reasonable care to ensure that all details, descriptions and prices of Products appearing on the Website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the Website as up to date as possible, the information including Product Descriptions appearing on this Website at a particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a Product until your order is accepted in accordance with our Order acceptance policy.

Wall Walks - Booking Terms & Conditions

 

  1. Booking and Payment - You may place a booking online, by telephone or by post. Your reservation will be made on receipt of a £50 deposit (for a maximum group size of six persons). Once the booking has been confirmed, you will be sent a ‘Booking Pack’ to the total value of the deposit - consisting of a Map, Guidebook, Kit List, Advice on Time & Distance and an Itinerary outline.

    The remaining balance becomes due six weeks prior to arrival. Final Payment options will be confirmed on acceptance of the booking.

  2. Cancellations - Should you have to cancel the booking, the deposit is non-refundable. After the final balance has been paid, should you cancel your booking within six weeks but not less than four weeks of arrival - we will refund the balance paid less the deposit and a £50 administration fee. Cancellations within four weeks of arrival are non-refundable. Should any member of your group withdraw before your final balance has been paid, there is an administration charge of £25 for each person that drops out from the initial booking. If it's after the final balance has been made and the cancellation is not less than four weeks of arrival, we will refund the balance paid by that person (or those persons) less a £50 per person administation fee. Cancellations within four weeks of arrival are non-refundable and in this situation, non-participants would need to make a claim on their own personal travel insurance.

  3. Insurance/Safety - It is expected that you will have taken out adequate personal insurance to cover yourself, your equipment and your luggage in the event of cancellation, personal accident, illness or loss of possessions. Hadrian’s Wall Ltd cannot accept responsibility for any loss, damage, illness or injury you might suffer on your walk. Also, we cannot accept any liability for any loss damage or injury resulting from ‘force majeure’ or any unforeseen circumstances beyond our control.

    In the interests of safety, you must read, understand and fully comply with our 'Safety Measures', as well as undertake to follow the advice of any warning or advisory notices encountered during your walk. You should also follow the Country Code and requests of the Hadrian’s Wall Path National Trail, acting sensibly and prudently at all times.

    Good walking skills are required. Please ensure you have the appropriate skills, fitness levels and equipment. If you have any doubts please refer to the ‘Kit List’ and ‘Advice on Time and Distance’ provided on booking or get in touch. The responsibility for ensuring the safety of the party rests solely with the party itself. We assume all clients will have a reasonable level of good health. Please advise us at time of booking of any medical condition or medication taken that may affect your walking ability or that would be useful for us to know in advance of being in remote areas.

    We regret that we cannot accept bookings from any person less than 18 years of age unaccompanied by a parent or legal guardian. Persons under the age of 18 will be the sole responsibility of the parent / guardian.

  4. Changes to Bookings - We reserve the right to change the itinerary where circumstances dictate. In the event that you wish to change any details of your booking we will do our utmost to help, however an administrative charge will be incurred. In extreme or unforeseen circumstance we reserve the right to cancel or refuse any booking, at which time we will refund all monies paid to us less the deposit. There will be no further entitlement to any compensation, damages or otherwise arising from the cancellation.

  5. Conditions Acceptance - Acceptance of the above conditions is implied when you make a booking and this constitutes the limit of our liabilities.

  1. Booking and Payment - You may place a booking online, by telephone or by post. Your reservation will be made on receipt of a £10 deposit (for a maximum group size of six persons). Once the booking has been confirmed, you will be sent a ‘Booking Pack’ to the total value of the deposit - consisting of a Kit List, Advice on Time & Distance and Campsite details.

    The remaining balance becomes due two weeks prior to arrival. On acceptance of the booking by Hadrian’s Wall Ltd, a refundable deposit amount to cover equipment hire, along with final payment options will be agreed.

  2. Cancellations - Should you have to cancel the booking, the deposit is non-refundable. After the final balance has been paid, should you cancel your booking within two weeks but not less than one week of arrival - we will refund the balance paid less the deposit and a £20 administration fee. Cancellations within one week of arrival are non-refundable.

  3. Insurance/Safety - It is expected that you will have taken out adequate personal insurance to cover yourself, your equipment and your luggage in the event of cancellation, personal accident, illness or loss of possessions. Hadrian’s Wall Ltd cannot accept responsibility for any loss, damage, illness or injury you might suffer during your stay. Also, we cannot accept any liability for any loss damage or injury resulting from ‘force majeure’ or any unforeseen circumstances beyond our control.
